UPGRADE OF THE INQUIRY ON THE POLICE TOP FOR THE DIAZ EVENTS

the historical truth, essentially, is already written.
the irruption into the diaz school was decided by the top managment of the
police forces which where in genoa for the G8, during a meeting held in the
evening of july 21st, after two days of riots with one death, hundreds of
injured and only a few arrested, in Colucci's office, head of police
administration.
presiding over the meeting was chief administrator Arnaldo la Brbera, head
of prevention police, arrived that morning from rome, with the presence of
Gratteri (head of SCO, operative central service) Calderozzi (his deputy),
Murgolo (deputy cheif administrator of Bologna), Mortola (chief of Digos
Genoa-political police) and from 10,30pm also Canterini (head
of Rome flying squad), all of them officials which will be at the school:
the signal to go was given by Gianni De Gennaro, over the telephone.
more than a search, which actually did not happened, a roundup was decided:
they wanted to have the highest number of arrests to face up a
disastrous outcome for the public order.
it is worth noting that police chief deputy, head administrator Ansoino
Andreassi,manifested his doubts and did not partecipate to the operative
meeting. besides, De Gennaro, by sending La Barbera to Genoa, practically
passed a motion of no confidence.
it is still to be cleared the reason why 70 officers of the special branch of
rome flying squad (former riot police) where employed and why such a cruent
ferocity during the irruption, to which dozens of other undercovered and
uniformed officers took part even if belonging to different departments.
the operation, officially justified with a stone attack which supposedly hit
a police department car, concluded with 61 injured out of the 93 protesters
found inside the school, of which the majority was sleeping and that
according to the recorded decrete of the accusations, more than closing the
gate and the main door (smashed through), did not perform any particular
resistance.
all the 93 were arrested with criminal association aimed to devastate and
robbery, according the records of the search and seige which stated the
discovery of improper weapons and two molotov cocktails, but the genoa
judges did not convalidate the arrests.

CHARGES:
the preliminary hearing opened on saturday june 26th 2004 for the beating
and false evidences at the diaz school, makes the interior ministry shake.
amongst the 25 defendants there are men extremely close to the police chief,
such as Francesco Gratteri, promoted at the head of anti-terrorism
department right on time to be presented as the new red brigades punisher;
important managers such as the prevention police chief Gianni Luperi
(coordinator of the european task force investigating anarchists);
investigators such as Gilberto Calderozzi (Gratteri's ex deputy),
Filippo Ferri (from the flying squad of La Spezia to Biagi's homicide
investigations) and Fabio Ciccimarra (also investigated in Neaples for the
violence against the arrested in the Raniero police station). these are
officers regulating dozens of men, which, apart from Luperi, come from the
flying squad and the common and organized crime fighting world, starting
with Gratteri and from De Gennaro himself. they must answer to falsity and
offence essentially for the fact of the two fake molotovs, together with the
other diaz record signers, from Mortola to the deputy chief Di Bernardini
(anti-robbery department, Rome flying squad) to deputy chief Pietro Troiani,
and to the former officer Alberto Burgio, which handled those two bottles
before they ended into the hands of the managers, filmed inside the yard
from a providential cctv camera.
as it concerns the beating inside the school, the people accused of personal
injuries are Vincenzo Canterini, Michelangelo Fournier (his deputy at the
flying squad department of rome) and the 8 team chiefs (Fabrizio Basili,
Ciro Tucci, Carlo Lucaroni, Emiliano Zaccaria, Angelo Cenni, Fabrizio
Ledoti, Pietro Stranieri e Vincenzo Compagnone).
the images, the declarations of Gratteri to the parlament commission and
the service reports of the chiefs themselves, merged with the depositions of
the beated which in some cases managed to recognise the uniforms, indicates
that the 70 roman riot police officers, all of them belonging to the special
anti-riot branch created before the G8, entered first, but that dozens of
policemen that took part to the beating with uniforms and undercovered, were
never identified.
the Public Prosecutor's office asked for the record of the accusations
against Canterini's agents.
one of them, Massimo Nocera, is accused of false testimony and offence for
denouncing of being stabbed from one of the school occupier, never
identified, during the operation.
one last group of functionaries and agents must answer to the arbirtary
search,damaging,robbery and personal injuries for irrupting into the pascoli
school, in front of diaz, where the genoa social forum's media center was
placed. computer destroyed, hard disk confiscated, seiged material.
the defendant are salvatore Gava, head of the Nuoro flying squad, the
neapolitan Alfredo Fabbroncini and the flying squad officer Luigi Fazio,
this latter accused of beating a young german boy.
during the hearing of the parlament commission investigating on the G8,
gratteri took the responsability for what happened at the pascoli school,
because it was him deciding to search also that building.

THE INVESTIGATION
the investigation on the search of the diaz started when the genoa judges,
after listening to the arrested people, refused to convalidate the arrests
and to transmit the acts to the public prosecutor of the republic.
meanwhile De Gennaro was obliged to nominate three super-inspectors for very
fast internal administrative investigations: one about the events in the
square, one on the tortures in the bolzaneto police quarter and one on the
diaz raid, entrusted to the public prosecutor (nowadays prfect) Giuseppe
Micalizio.
in a few days Micalizio concluded that the operation was badly organised and
that the unjustified violence actually happened. on the basis of his
conclusions, three important measures trigger. removed from their duty are:
deputy chief of the police Ansoino Andreassi, the anti-terrorism number one
Arnaldo Barbera and the chief administrator Francesco Colucci, (practically
all those poeple who were against the raid into the school), while Canterini
proposed the firing of the state police. right afterwards De Gennaro, la
Barbera, and Canterini himself were listened from the mp members of the
investigation committee for the g8: just a little or nothing of what the
magistrates will discover, but enough to see the police chief in serious
difficulty, Gratteri which instead defends the operative choices (searchs
are not made with gloves) and La Barbera and Canterini publically clash, the
former stating that he adviced not to go for the raid without being listened
from the latter. "I told him: let's pass this on, it is not the case".
however at the republic Attorney this was not enough to put under accusation
all the functionaries which were at the raid.
at the beginning, in July and August 2001, nobody is inscribed in the
investigation register,the policemen can only be listened as witnesses. the
arm wrestling starts between the chief public prosecutor francesco Meloni,
supported by Francesco Lalla which will take his place in 2003, and the
substitutes that take part to the case directly, enrico Zucca and francesco
Pinto, to wich are added Francesco Cardona Albini, Monica Parentini,
Stefania Petruziello and Vittorio Ranieri Miniati. the police obstructioning
begins: nowadays, a complete list of the 270 policemen taking part to the
radi still does not exist. and it takes months in order to identify the 14
signers of the records, actually 13 because the 14th signature will always
be unreadable. a few months later however, Canterini and the whole
department are under investigation for partecipation in personal injuries.
a real turning point arrives in november 2001. the Prosecution service
points out that Pasquale Guaglione, chief deputy of Gravina di Puglia
(Bari), in service in genoa for the g8, stated he gave to the police
departments the two bottles containing molotov cocktails found in Corso
italia during the disorders of the late afternoon of july 21st. the good guy
wrote this to the service relation, but the records of confiscation of the
two bombs was missing, considered as war weapons.
and the absence of the recors made the public service functionaries Pinto
and Zucca suspicious, therefore they decided to question guaglione from bari
public prosecutor, using a little investigative trick. the bottles
confiscated in the diaz were shown to the agent, without telling him that
they were the ones of the school and asking if they were those found in
corso italia. he recognised immediately as those found from his patrol,
because he remebered the labels of famous wines. moreover, guaglione
referred that he did not give them to a simple officer but to valerio
Donnini, manager which was in genoa as responsible of all the riot squad
departments and is father of the anti-riot squad which entered inside the
diaz: the police chief, during the meeting with la barbera, calls him over
the phone for the mobilitation of the squad.
and actually on Donnini's jeep magnum, drove by former agent antonio Burgio
and with deputy police chief pietro Troiani, the two bottles ended up in the
diaz. the public prosecutors knew from the driver, which was the same
of corso italia, a young boy who regretted what he had to do and for this
reason he resigned from the police force, where moreover he could not get
rid of the grasser mark.
in may 2002 the prosecutors receive the scientific investigation department
response related to nuocera's jacket and bulletproof waistcoat, which was
supposedly stabbed during the diaz serach. in the colonel garofano report
and at page 16 it is possible to read that the tests of cutting performed
demonstrated, contrarily to what was observed on the evidence material, a
nearly perfect alignment between the laceration produced on the jacket and
on the waistcoat underneath. on the contrary, the scientific investigation
department of carabinieri, write at page 19 that the cuts are not aligned.
there is therefore an evident uncompatibility between the cuts on the
evidence clothes and those obtained testing according to the dinamics of the
accident affirmed by nuocera.
at this point agent nuocera can only change his version: on october 7th
2002, after 15 months from the events, he will say that the stabbing was not
just one,(as he clearly stated twice before, on the service records and in
front of the prosecutors), but were actually two.
lately, with the probatory accident procedure, a second examination will
intervene, by doctor carlo La Torre (already responsible for defiling the
investigation on carlo giuliani's death suggesting the theory of the stone
wich would have deformed the bullet trajectory): according to la Torre
Nuocera second version is compatible with the cuts reported on the clothes.
for the experts of the offended people the clothes have lacerations which
make think to at least 4 distincted stabbs.
but the central point of the investigation is now the bottles episode. in
june 2002 the porsecutors have a film shot by a genovese transmission
(primocanale) showing a group of very high grade functionaries with a blue
plastic bag containig the two bottles, in the yard of the school. strike.
hence it is possible to understand in the hands of whom the bottles ended up,
brought there by burgio on troiani's demand.
the video shows Luperi, Caldarozzi, Murgolo, Gratteri, Canterini, passa di
lė anche La Barbera around the bag: none of them, up to now, admitted to
have seen the bottles in the yard. maybe they have seen them later, anyway
without plastic bag.
on july 31st the prosecutors make them properly repeat this version, then
switch the lights of, and screens the video to the agents. Luperi, after the
video, looses his speech and chooses not to speak anymore. Gratteri still
answer and throws the responsability to canterini department, according to
the line decided by de Gennaro. but he leaves the building vey angry. he
knows he won't be able to avoid the accusations. the only one who is safe is
Murgolo, former Bologna chief deputy, nowadays manager of the military
secret service (sismi): the prosecutors ask for the filing of murgolo
because at the time he was there in representation of Andreassi, staying
outside the two chains of command individuated by the investigations: the
one of the flying squad, headed by calderozzi and gratteri, and the one of
the digos (political police) heads la barbera and luperi. all of them anyway
avoid the accusation about the beatings because they demonstrated they
arrived at the school later.
the interrogations cleared that the molotovs arrived in the yard because
they were brought by burgio, on troiani's demand, who still nowadays did not
cleared why he was there. officially he was not amongst the partecipants to
the raid, he went there as going to a party. according to troiani, assisted
by lawyer biondi, former justice minister, the two bottles ended up into
bernardini's hands, deputy police chief added to the anti-robbery squad of
rome. instead he denied to have taken them, admitting only to have seen the
bottles in the yard in somebody else's hands.the two maintained two
differnet versions even if the police tried to make them agree: when Troiani
received the convocation by the genoa prosecutors, the roman police
department gave him di Bernardini's mobile number.
it is anyway sure that the bottles arrived to calderozzi, deputy of
Grattieri and therefore direct supervisor of di bernardini (in the diaz
school the agents depended on Grattieri and Caldarozzi). and caldarozzi
actually appears on the yard video. obviously all the investigated defend
themselves, saying that they did not take part to any offensive plan. anyway
they are struggling to admit that none of them, even if they are expert
investigators, tried to have informations on the precise origin of the
weapons. where were they found? by whom? in the records, written by
Ciccimarra and Ferri and signed by Calderozzi as well, it is written that
the bottles were found inside the school, in the gym at the ground floor, in
order to make them result as desposable for the 93 arrested occupiers.
and this information, at the end of the investigation, resulted as fake and
offensive. it is not the only one, anyway: on the records, rock sacs supports
are indicated as batons, improper weapons, and a long catalogue of other
objects aimed to offend is taken from a workers' tools storage which
remained close until the police arrived.
the trial, if the judge daniela Faraggi will decide to take action, will be
held on this. in front of the tribunal grattieri and the others will have to
explain that they were there but did not take part to the calumnies and
falsity: if instead they realised that, they were meant to take action, in
quality of public officials as they are, and if they did not, the law
considers them guilty as the practical responsibles are (article 40 second
comma, penal code). it will be a circumstantial trial, as many are, but
built on material a bit more substantial than a few phone calls, that maybe
can be worth an accusation of armed band in one of the many investigations
signed by these lords.
