Appello urgente contro l'espulsione e la deportazione dell'attivista statunitense dell'ISM in Palestina Susan Barclay

Susan Barclay http://italy.indymedia.org/news/2003/02/182526.php, attivista statunitense dell'ISM in Palestina, e' stata recentemente arrestata dalle forze di occupazione israeliane e ora sta' per essere espulsa da Israele e deportata con la forza nel suo paese d'origine.

Si chiede a tutti di telefonare all'ufficio del Primo Ministro 00972 2 670 5555 / 00972 2 670 5510 e di pretendere che vanga sospesa ogni procedura di espulsione nei confronti si Susan Barclay anche perche' cio' va contro le decisioni dello stesso sistema legale israeliano, in particolare di quella dell'Hadera District Court.

I have just received a call from Susan Barclay who is in Mikhal Prison and
spoke to me on a phone that had been smuggled into her.
 
She told me that the guards have told her that she is going to be deported
at 10 pm tonight but she is determined to resist to stay in the country and
continue the struggle for a free Palestine.
 
We have contacted her lawyer and he has told her that the deportation is a
pre-emption of the legal process and is totally illegal and that if she is in the
country tomorrow morning she he can defend her. 
 
Susan has been working with the ISM in the city of Nablus for the past six
months documenting Israeli war crimes against the people of Nablus and
the surrounding villages and confronting the occupation of the West Bank
through non-violent direct action.  Because of this she was detained and
arrested at an Israeli military checkpoint last Thursday and has been
served with a deportation order on the bassis that she is a security threat
to the state of Israeli.
 
It is up to Susan now to see if she can successfully resist her deportation
from the country but you can help her in this by contacting the Israeli
embassy/ consulate in your part of the world and demanding that the
Israeli authorities observe due process and that this extraordinary young
woman be granted her day in court where she can defend herself against
the charges that her presence in Israel and Palestine constitutes a threat to
Israel's security. 
 
Please contact your local Israeli mission and inform them that the world is
watching and demand that the Ministry of the Interior abort this illegal
deportation of a non-violent humanitarian activist.

At 5.20 am I got a call from Susan who was on a KLM flight out of Israel. The plane was still on the tarmac and she was refusing to take her seat.

It was the second time the Interior Ministry had tried to fly her out since her removal from the Mikhal Detention Facility.

The plane was scheduled to take off at 5.40 am and Susan was threatening to open the overhead lockers to prevent it taking off. While I listened the police arrived to try and negotiate with her and then take her off when the flight crew declared that they would not depart with her on board.

She told me that she was literally dragged onto the plane but was not hurt. She is now in a police holding centre at Ben Gurion Airport. We have contacted her lawyer who is in touch with her.

At this stage it seems that the Interior Ministry has failed in its attempt to pre-empt the legal process by smuggling her out of the country during the night and that Susan will have her day in court.

Thank-you for your support during the phone-in last night. I had reports of all 75 lines to the Israeli embassy (including cultural and educational numbers) being jammed by Susan's reporters.

It is now 6.20 am.

Yesterday we forwarded an emergency call of the internationals group ISM. We
suggested you to phone to the Prime Minister's Office about the attempted
deportation of humanitarian worker Susan Barclay, active in Nablus. Her deportation
would have been in contravention of the Hadera Magistrate's Court decision.
Today we were informed by Adv. Shammai Leibovitz - with whom we were constantly
in contact - that in the night Barclay had been carried, passively resisting, onto a
plane before he could even take legal action. However, after she made clear to the
crew that she was in the plane against her wish, that she would not obey instructions
about getting seated, and even threatened
to open the luggage bins, the KLM pilot decided that he couldn't take
responsibility and she was returned to the Ben Gurion Airport police office.

Barclay's firm stance won her enough time to let others work on her behalf:
The switschboard at the PM's Office was flooded, and at a certain point
became inaccessible. And in the early morning Adv. Shammai Leibowitz
got an order from Judge Michaela Shidlovsky-Or of the Jerusalem District
Court for the immediate release of Susan Barclay. Now, Leibowitz is
considering proceedings for financial damages due to the illegal deportation
attempt..

In a major coup for the forces of peace and justice, Susan Barclay, the ISM peace activist who had been imprisoned without trial and threatened with deportation, has been released after a dramatic turn-around in events which has left the Israeli security forces totally discredited.

Events started to look ominous for the Israeli police after Susan had refused to take a seat on the KLM plane that she had been forcibly dragged onto. Susan explained to the pilot and flight crew that she was being illegally deported as she was in the process of appealing against a deportation order. Consequently, the flight crew refused to fly with her on board. In spite of the efforts of a police officer who threatened her with an even more brutal deportation, she heroically walked off the plane and back into the airport.

Looking forward to her first night out of prison for over a week, a jubilant Susan said, "He threatened me with handcuffing and a gun at my head the next time. In response, I said, 'Well after [what we went through in] Nablus, that would be nothing!'"

The appeal hearing later that morning vindicated Susan's determined stance in the face of the state's attempts at intimidation by ordering her immediate release.

Judge Michaela Shidlovsky-Or ruled that the state did not have the right to demand Susan's immediate deportation and that subject to certain conditions, she could not be removed from the country until 10th March. The principle condition is that a copy of an outward bound ticket from Israel to Turkey be faxed to the court by Sunday 2nd March, for a flight on that day.

Susan is at present discussing her options with legal counsel.

In the face of what often seems like an uphill struggle against the forces of evil oppression in Israel, this piece of news can be considered an important victory for justice.

To each and every one....

I just wanted to write a very quick note to let people
know that I am indeed free, and beyond happy. I just
wanted to say an immediate, incredibly sincere THANK
YOU to all the people who worked so very hard to
support me. I can not tell you how much it means. I
have been very busy and will be meeting with my lawyer
tomorrow to discuss various legal possibilities and
then I hope to find the time to write an account of
exactly what happened. THANK YOU AGAIN.
