Oggi, quattordicesima udienza del processo ai 26 per devastazione e saccheggio.
Ultima udienza dei teste dell'accusa senza l'uso di supporti video, che non
possono essere usati fino a che la difesa non avra' valutato e visionato i
materiali che il pm potrebbe produrre e usare per l'esame dei teste.
Il primo testimone di oggi e' marino baldassarri, un privato cittadino di faenza
che recatosi a genova per seguire la manifestazione e per "fare delle foto", si
ritrova nella zona dei disordini intorno a corso marconi, realizzando una serie
di fotografie e cercando di identificare alcuni dei manifestanti protagonisti
secondo lui delle devastazioni. L'esame realizzato con l'ausilio delle sue foto
ha ripercorso i disordini di corso marconi e mentre l'accusa cerca di usare la
testimonianza per inchiodare uno degli imputati, il controesame della difesa ha
evidenziato svariate contraddizioni e "dimenticanze" nella ricostruzione del
teste.
Il secondo teste e' un giornalista free lance di roma che viene rapinato della
sua borsa con alcuni materiali fotografici dopo essere stato aggredito in corso
torino subito dopo la partenza del corteo da piazza paolo da novi e l'inizio dei
disordini in quella zona venerdi' pomeriggio.
L'esame del teste ricostruisce l'accaduto, inclusi le ripetute richieste di non
fotografare prima dell'aggressione, che comunque per stessa ammisione del teste
non e' stata molto violenta e non gli ha provocato ferite o lesioni. Dall'esame
si testimonia anche come la borsa sia stata ritrovata inseguito e restituita,
anche se priva di materiali, al legittimio proprietario. Il controesame della
difesa mette in evidenza che nessuno degli imputati e' riconosciuto dal teste
come coinvolto nell'azione.
L'udienza si conclude cercando di comprendere quali potessero essere i teste
della prossima udienza e quando effettivametne cominciare il controesame dei
materiali documentali. Dal dibattito emerge che l'accusa non ha altri teste
interrogabili senza l'ausilio di video, nonostante lo stupore dello stesso
presidente del collegio, e che quindi la prossima udienza viene fissata per il 6
luglio, mentre accusa e difesa si impegnano a dare il piu' presto possibile
confermare che tutto il materiale del fascicolo della procura sia arrivato alla
difesa e che il materiale sia acquisibile come reperto.

Here comes a summary of the 14th hearing of the court case against 26 activists accused of devastation and looting of genoa on july 20th and 21st 2001.
The hearing took place in genoa on june 15th, 2004.
It is the last hearing of prosecutor witnesses without the use of videos. the use of videos have been postponed until the defense team won't have finished to see and evaluate the videos the prosecutor presented as evidence.

The first witness is marino baldassarri, who from faenza has gone alone to genoa on july 21st to "take pictures" and who finds himself in the middle of the rioting happening in corso marconi. He then takes a lot of pictures trying to identify some of the activist taking part to the destruction of chains, shops, banks, cars and so on, to his saying at least. The witness hearing is made using his own photo as a tour guide to the rioting. While the prosecutor is trying to use the photos to frame one of the activist involved in the court case, the defense manages to show a lot of contraddictions and "holes" in the memory of the witness and his tale of the day.

The second witness is a free lance journalist who has been robbed of his bag of photografic equipment after having been assaulted by a group of people in corso torino, some minutes after the beginning of the cobas demo in piazza paolo da novi and the starting of the riots in the area around the same square on july 20th afternoon.
the witness tells what happened, including the repeated request to not take pictures by the protestors before the assault, which he himself says to have not injured him. From the hearing on can also see on the bag was later found and given back to him by another protestor, even if empty of the equipment. The defense questions has stressed that no one of the people involved in the court case have been recognized by the witness as part of the assault and robbery.

The hearing ends trying to define how the court case should proceed: the final decision is to postpone the next hearing to july the 6th, since the prosecutor needs the videos and the defense says that the minimum amount of time needed to screen all of the material is the first week of july, to say the least.
